27. Facts found: Viking Vendetta was approaching the windward mark of a buoys to port course on port tack as shown in the diagram at left. He called for room from Yesterday’s Jesper who was coming in on starboard. Jesper refused room and Vendetta was forced to bear away to avoid colliding with Jesper. Vendetta protested.

Decision:Rule 18 does not apply "between boats on opposite tacks when they are on a beat to windward" (rule 18.1b). Therefore Yesterday's Jesper was not obliged to give room to Viking Vendetta and rule 10 (opposite tacks) applied in this situation. The onus was on Viking Vendetta to keep clear and she did so. No rule was broken and the protest is disallowed.
